Agreement between the Government of the Republic of Hungary
and the Government of the United States of America
Concerning the Operations of the United States Peace Corps in Hungary

 

 

    (1) The Government of the Republic of Hungary (hereinafter: "the Hungarian Party") and the Government of the United States of America (hereinafter: the American Party) agree in regard to the operations of the Peace Corps in Hungary as follows:

    (2) The American Party agrees to furnish, and the Hungarian Party agrees to receive, Peace Corps volunteers, traveling to Hungary on U.S. passport, for the performance of tasks to be jointly defined by the parties in protocol(s) implementing this Agreement. The American Party shall provide training to enable the volunteers to perform effectively the jointly defined functions. The volunteers shall work under the supervision of organizations jointly agreed upon by the Parties. The individuals to be received as volunteers shall be jointly agreed upon by the Parties on the basis of conditions specified in the protocol. The Hungarian Party shall accord equitable treatment to the volunteers and their property and afford them full aid and protection no less favorable than that accorded generally to United States citizens residing in Hungary.

    (3) The Hungarian Party agrees to receive a representative of the Peace Corps and such members of the staff of the representative as may be necessary to implement this Agreement and maintain liaison with the designated representatives of the Hungarian Party. The Hungarian Party also agrees to receive individuals performing services for the Peace Corps pursuant to contract in order to implement this Agreement, who shall also be deemed staff of the representative. The representative and staff members will be received only with the advance agreement of the Hungarian Party.

    (4) The Parties agree that the persons described in article (3) shall travel to Hungary on other than Hungarian passports. This limitation does not prevent the Peace Corps from employing persons other than those described in article (3).

    (5) The Hungarian Party shall permit the importation of articles for the personal use of the volunteers, their spouses and their dependent children at the time of their arrival in Hungary and for a period of six months thereafter. Such importation shall be free of customs duties, taxes and other public charges, provided that the articles imported shall not be alienated in Hungary. Charges for storage, transportation, or similar charges, if incurred as a result of actions or omissions of the volunteer, the importing individual, or the Peace Corps are not included in the exemption.

    (6) The Hungarian Party shall exempt the persons described in article (3) and their spouses and dependent children from the customs duties, taxes and charges specified in article (5) for the entire period of their stay in Hungary.

    (7) The income taxation of persons described in articles (2) and (3) shall be governed by the Convention for the Avoidance of Double Taxation and Prevention of Fiscal Evasion signed between the Parties in Washington on February 12, 1979. Such persons, if citizens of the United States, shall be deemed resident of the United States, and sums paid to them by the Peace corps shall be deemed remuneration for government service to the United States for purposes of the said Agreement.

    (8) The Hungarian Party shall grant entry visas to persons specified in articles (2) and (3) without requiring the payment of fees, provided that such entry serves the purposes of implementing this Agreement. Consistent with Hungarian law, the Hungarian Party shall grant, without charge, permissions to stay, as well as multiple exit and entry permits for these persons. No work permit shall be required for persons specified in articles (2) and (3) for the performance of activities that relate to the Peace Corps.

    (9) The American Party shall provide the volunteers with such limited amounts of equipment and supplies as the parties may agree are needed to enable the volunteers to carry out their duties in an efficient and effective manner. Material imported into the Republic of Hungary by the American Party pursuant to this article in order to implement this Agreement shall be exempt from customs duties and taxes. Materials purchased within the Republic of Hungary by the American Party pursuant to this article in order to implement the Agreement shall be exempt from taxes. Articles imported or purchased pursuant to this provision shall not be alienated within the Republic of Hungary except to an individual or organization holding a similar exemption from duties and taxes or by donation to an agency of the Government of the Republic of Hungary or an organization supervising volunteers under this Agreement.

    (10) The Hungarian Party shall provide, free of charge, emergency medical care within Hungarian territory to the persons described in articles (2) and (3), as well as to their spouses and dependent children.

    (11) Any convertible currency or negotiable instrument brought to the territory of the Republic of Hungary by the American party for purpose of implementing this Agreement may be converted into Hungarian currency at the highest rate of exchange at an authorized agency in Hungary and utilized without restriction.

    (12) The Hungarian Party shall designate the appropriate government agencies, and the American Party designates the Peace Corps to implement this Agreement, as executive agents.

    (13) Authorized representative of the executive agents may enter into such agreements as they deem necessary or desirable for the implementation of this Agreement or for a better application of this Agreement under circumstances not provided for herein. The executive agents shall review annually the provisions of the protocol(s) implementing this Agreement and may amend such protocol(s) by joint agreement. The executive agents shall cooperate closely, consult, and exchange information concerning all issues related to the operations of the Peace Corps in Hungary and shall take all necessary steps to implement this Agreement.

    (14) This Agreement shall enter into force upon the Parties' mutual notification of having fulfilled their respective legal requirements. The undertakings of the Parties are subject to the availability of funds and to the applicable laws of their respective countries.

    (15) This Agreement shall remain in force until three months after either Party provides written notification to the other Party of its intention to terminate it. The Agreement may be amended by mutual written agreement between the Parties.

 

IN WITNESS WHEREOF the duly authorized representatives of the parties have signed this Agreement.
