MFA Decree No. 1/1991 (IV.9.)
on Consular Fees

 

On the basis of the authorization provided for in Subsection (2) of Section 67 of Act XCIII of 1990 on Duties and in agreement with the Minister of Finance, the Minister of Foreign Affairs hereby issues the following Decree:

Section 1

Consular fees and, if so provided for by legal regulations, duties or fees imposed by other authorities (hereinafter referred to as "fees") shall be paid for procedures related to applications submitted to and services rendered by the Consular Department of the Ministry of Foreign Affairs or Hungarian diplomatic or consular missions (hereinafter referred to as "consular authority").

Section 2

The subject and amount of consular fees are included in the Schedule to the Decree.

Section 3

With the exception of fees fixed at a per cent rate, consular authorities may reduce or cancel consular fees upon consideration of the financial and income situation of the party obliged to pay the fee.

Section 4

The following are exempt from the payment of consular fees:
a) official actions taken at the request of institutions financed by the Hungarian government;
b) official actions taken on behalf of an employee of an institution financed by the Hungarian government who has been officially delegated by such institution, if said actions directly relate to his mission or official capacity;
c) official actions which are free of charge as provided for by an international agreement.

Section 5

(1) Consular fees and other duties (fees) and charges charged by the Hungarian authority must be paid to the consular authority in United States dollars (USD) or in the convertible foreign currency used by the country in question, or, in exceptional cases, in local currency.
(2) If the application has been submitted to the Consular Department of the Ministry of Foreign Affairs, fees shall be payable in forints, with the exception of any expenses incurred in a foreign currency.
(3) The foreign exchange sale rate published by the Hungarian National Bank shall be employed for the conversion to other convertible currencies or forints; for conversion to local currency, the local exchange rate shall be employed.
(4) Payment of the fee shall be indicated on the document.

Section 6

This Decree shall enter into effect on 15 April 1991. Simultaneously upon entering into effect KüM Decree 1/1984 (III. 10.) on Consular Fees and KüM Decree 1/1988 (III. 29.) on the Amendment thereof are repealed.
